CLE Program: Aren’t You My Attorney? – Ethical Concerns In Failing to Properly Identify Your Client

Like any other practice area, the IP field is filled with numerous instances where failing to properly identify who exactly you represent – from joint authors to collaborators to co-inventors, CEOs to sole proprietors to self publishers – could give rise to ethics violations, unhappy clients and even possible malpractice claims. We will examine a few IP-specific scenarios where identifying the correct client is vital, and discuss some of the ethical concerns that may arise when facing these and similar situations, as well as a few practical solutions that attorneys need to keep in mind in order to help avoid breaching your ethical duties to your clients.
