United States Copyright Law (17 USC Sec 101 et seq) provides that an unauthorized derivative work is an infringement of the author’s exclusive rights. The law further gives limited “moral rights” protections to artistic works. How, then, can a court say that it is permissible for someone to create a work that recasts a photograph as a nearly identical sculpture? How is it legal to take a photo, scribble on it, and publish it as your own? Has “transformation” swallowed copyright?
This term we may learn how the Supreme Court views such issues (or how it will once again ignore the clear words of a statute).
Before the court rules, come learn just how absurd it can get in the “art world”.
