In 2017, the Supreme Court declared the Lanham Act’s ban against federal registration of “disparaging” trademarks unconstitutional under the First
Amendment. But that ruling specifically left open the question of whether
“immoral” and “scandalous” trademark registrations should remain banned.
Join us for a lively discussion of Iancu v. Brunetti, the case that will cause
the Supreme Court to consider the constitutional protection afforded the
