Program: Who’s a Phan of Termination Under
Section 203 of the Copyright Act?

The
Phillies recently settled its lawsuit in the Southern District of New York
against the folks who built the original Phanatic costume back in 1978, thereby
obtaining all copyright rights to their beloved mascot. The lawsuit raised
interesting issues about authorship, copyright in “characters,”
derivative works, implied copyright licenses, the copyright statute of
limitations, and, of course, termination under Section 203 of the Copyright
Act. Lead counsel for The Phillies in that litigation–Dave
Wolfsohn–will talk about those issues, and the implications of this case for
future termination scenarios under the 1976 Act.
