CLE Program: Redesigning Design Patent Law
Speaker: Professor Amy L. Landers, Director of the Intellectual Property Law Program at Drexel University Kline School of Law
Description of CLE Program: In LKQ Corporation v. G.M. Global Technology Operations L.L.C. (LKQ), the Federal Circuit took a major step in strengthening the obviousness standard for design patents. This begins to harmonize the standard for both design and utility patents. This session will provide some background for the decision, examine the opinion’s most important points, and propose some implications for this area of the law going forward.
